This picture depicts the 10 amendment as the state is angry that obama is trying to control people. The problem the state has is the fact that it is supposed to do that which relates back to the 10th amendment in that any powers not given to the gov are given to states. The satire in this cartoon is the fact that obama is criticized a lot for extending his powers as president. The state comes in criticizing obama for doing this while in reality it wants to go do that itself , increase its power .
historical context
In mc gray vs the united states in 1904 a tax was set on what was essentially an artificial butter. The problem with this is that there was no tax on actual butter so people like mc gray who made artificial butter got mad and sued as he felt the government was overstepping its boundaries on putting a random on necessary tax in the butter he liked to use. This shows a violation of the 10th amendment as the government did not have the right to place the tax but rather the state did .
contemporary example
A contemporary example of the 10th amendment being violated would be in an article posted by the 10th amendment center on april 22 2016 titled “The President, the Court and Immigration”. This article talks about how during obama's administration he breaks the 10th amendment by rewriting immigration laws.The law would change how deportation would be handled. As a result these laws would be reinforced by states and as a result they were violating the 10th amendment as that is not power that was assigned to the executive branch to make laws for states .
